What is Trademark Registration?

Trademark registration protects your brand name, logo, or slogan from unauthorized use by others. It's a legal recognition that gives you exclusive rights to use your brand identity in commerce. Once registered, your trademark is valid for 10 years and can be renewed indefinitely.

Frequently Asked Questions

What is a trademark class and how do I choose?
There are 45 trademark classes - 34 for products and 11 for services. You must register in classes relevant to your business. For example, if you sell clothing, register in Class 25. If you have an online store selling clothing, also register in Class 35 (retail services). Our FREE search includes class recommendation - we'll identify the right classes for complete protection.
Can I register my business name as a trademark?
Yes! You can register your business name, logo, slogan, or any combination as a trademark. You can register just the text (wordmark), just the logo, or both together. Most businesses register both for complete protection. Having a company/LLP registered doesn't automatically protect your brand - you need separate trademark registration.
What's the difference between ™ and ®?
™ (Trademark symbol) can be used immediately after filing your application - it indicates your trademark is pending registration. ® (Registered symbol) can ONLY be used after you receive the registration certificate (8-18 months). Using ® before registration is illegal and can result in penalties. Both provide notice that you're claiming rights to the mark.
Can someone else use my brand name if there's a similar trademark?
Once registered, you have exclusive rights to use your trademark in the registered classes. Others cannot use identical or deceptively similar marks in the same class. However, the same name can exist in different classes (e.g., "Apple" for computers and "Apple" for restaurants). This is why proper class selection is crucial. Our free search checks for all conflicts.
What if there's already a similar trademark?
This is exactly why our FREE trademark search is essential! We check for identical and similar existing marks before filing. If there's a conflict, we'll: 1) Suggest modifications to make your mark distinctive, 2) Recommend alternative names, 3) Check if the existing mark is in different classes (then you may still register). Discovering conflicts after filing wastes time and money.
How long is trademark protection valid?
Trademark registration is valid for 10 years from the date of application (not approval date). It can be renewed indefinitely for additional 10-year periods. You must renew 6 months before expiry. We offer renewal service at ₹7,999. As long as you keep using and renewing your trademark, it's protected forever.
Do I need to register in multiple countries?
Trademark protection is territorial - Indian trademark registration only protects you in India. If you do business internationally, you should register in those countries too. Many businesses start with India and add international registration as they expand. We can help with international trademark filing through Madrid Protocol (covers 120+ countries).
What happens during the objection stage?
The Trademark Registry examines all applications. If they find any issues (similar existing marks, descriptive names, etc.), they issue an examination report with objections. This happens in about 30-40% of cases. Don't worry - most objections can be overcome with a proper legal reply. We handle objection replies at ₹3,999 (separate from basic package). About 80% of objections are successfully cleared.
Can I apply for trademark without starting the business?
Yes! You can file "intent to use" application before launching your business. This is actually smart - it secures your brand name before competitors take it. However, if you don't start using the trademark within a reasonable time (typically 3 years), it can be challenged. Many startups register trademarks during the planning stage.
