Please read this Refund Policy carefully before booking any service. By purchasing our services, you acknowledge and accept this policy.

1. General Refund Policy

At NyayaNow, we strive to provide high-quality services and ensure customer satisfaction. However, due to the nature of legal and compliance services, refunds are handled on a case-by-case basis subject to the conditions outlined below.

This Refund Policy applies to all services offered through NyayaNow's platform.

2. Non-Refundable Items

The following are NOT eligible for refund under any circumstances:

2.1 Government Fees

  • Once government fees are paid (e.g., ROC fees, trademark filing fees, GST fees), they are non-refundable
  • Government authorities do not refund fees, even if application is rejected
  • This includes stamp duty, registration fees, filing fees, etc.

2.2 Completed Services

  • Services that have been completed and delivered
  • Documents that have been filed with authorities
  • Consultations that have been provided
  • Certificates and registrations that have been obtained

2.3 Services in Progress

  • Services where substantial work has been completed (>50% progress)
  • Applications already submitted to government departments
  • Legal notices that have been sent
  • Trademark searches already conducted

2.4 Third-Party Costs

  • Fees paid to third-party professionals (advocates, CAs, CSs)
  • Courier and postal charges
  • Notary and attestation fees
  • Payment gateway charges

3. Refund Eligibility

You may be eligible for a refund in the following situations:

3.1 Service Not Commenced

  • If you request cancellation before we start working on your service
  • If no documents have been prepared or filed
  • If no government fees have been paid

Refund Amount: 100% of professional fees (government fees, if paid, are non-refundable)

3.2 Duplicate Payment

  • If you accidentally made duplicate payment for same service
  • If there was a technical error in payment processing

Refund Amount: 100% of duplicate amount

3.3 Service Not as Described

  • If the service delivered is materially different from what was described
  • If there was a clear error in service description on our website

Refund Amount: Determined on case-by-case basis

3.4 NyayaNow's Inability to Deliver

  • If we are unable to provide the service for reasons within our control
  • If we decide to discontinue a particular service

Refund Amount: 100% of fees paid (minus government fees already deposited)

4. Partial Refunds

Partial refunds may be considered in the following scenarios:

4.1 Service Partially Completed

If you request cancellation after work has begun:

  • We will assess the work completed (as percentage of total service)
  • Refund will be calculated as: Total Fee - (Work Completed % × Professional Fee) - Government Fees - Third-Party Costs
  • Minimum deduction: ₹500 for administrative and processing costs

4.2 Timeline Example

  • Within 24 hours of payment: 90% refund of professional fees
  • After document preparation starts: 50% refund of professional fees
  • After government filing: No refund (government fees non-refundable, work substantially completed)

5. Specific Service Refund Policies

5.1 Company/LLP Registration

  • Before name approval: 90% refund of professional fees
  • After name approval, before incorporation: 50% refund
  • After incorporation filing: No refund (government fees non-refundable)
  • If name rejected: No refund, but free name resubmission

5.2 GST Registration

  • Before application filing: 90% refund
  • After filing: No refund (government processing started)
  • If application rejected: No refund, but free 1 revision filing

5.3 Trademark Registration

  • Before trademark search: 100% refund
  • After search, before filing: Refund minus ₹500 search fee
  • After application filing: No refund
  • If objection raised: No refund, objection reply available at additional cost

5.4 Legal Notice

  • Before notice drafting: 100% refund
  • After draft prepared, before sending: 50% refund
  • After notice sent: No refund

5.5 FSSAI License

  • Before application submission: 90% refund
  • After submission: No refund
  • If inspection required: No additional charges, included in package

5.6 Income Tax Filing

  • Before ITR filing: 90% refund
  • After ITR filed: No refund
  • If notice received: Reply services available at additional cost

6. Non-Refundable Situations

Refunds will NOT be provided in the following cases:

  • Change of mind after service commencement
  • Rejection by government authorities due to ineligibility or incomplete documents provided by client
  • Delays caused by client in providing documents or information
  • Delays caused by government departments (processing times vary)
  • Client provided incorrect or fraudulent information
  • Client failed to respond to our communications within reasonable time
  • Government policy changes or rule changes
  • Client opted for expedited service and urgency no longer exists

7. Refund Request Process

7.1 How to Request a Refund

    • Your name and registered email
    • Service name and booking ID
    • Payment transaction ID
    • Reason for refund request
    • Supporting documents (if any)
  3. Request Review: We will review your request within 5 business days
  4. Decision Communication: We will email you our decision with explanation

7.2 Refund Processing Timeline

  • Review: 5-7 business days from request submission
  • Approval Communication: 1-2 business days
  • Refund Initiation: 3-5 business days from approval
  • Credit to Account: 5-10 business days (depending on bank)
  • Total Time: 14-24 business days from request to credit

7.3 Refund Method

  • Refunds will be processed to the original payment method used
  • For cash payments, refund via bank transfer (provide bank details)
  • For payment gateway: Refund to original card/account
  • For UPI: Refund to UPI ID used for payment

8. Deductions from Refund

If refund is approved, the following may be deducted:

  • Government fees (if already paid to authorities): 100% deduction
  • Third-party professional fees: 100% deduction
  • Work completed: Proportionate deduction
  • Payment gateway charges: 2-3% deduction
  • Administrative costs: Minimum ₹500

9. Chargebacks and Disputes

If you initiate a chargeback or payment dispute:

  • Please contact us first - we'll try to resolve the issue
  • Chargebacks may result in suspension of services
  • If service was already delivered, chargeback is not appropriate
  • We reserve the right to take legal action for fraudulent chargebacks
  • Your account may be terminated if chargeback is unjustified

10. Exceptions and Special Cases

Exceptions to this policy may be made at NyayaNow's sole discretion in cases of:

  • Extreme and extenuating circumstances
  • Proven fraud or misrepresentation by NyayaNow
  • Legal requirement or court order
  • Goodwill gestures for long-term clients

11. Modifications to Service

If you wish to modify or change your service:

  • Modifications may be possible before service commencement
  • Additional charges may apply for service upgrades
  • Downgrades may not result in refund of price difference
  • Contact us to discuss modification options

  • Addressing your concerns about the service
  • Providing additional support or clarification
  • Offering alternative solutions
  • Modifying the service scope if possible
